Terms of Service and User Agreement

Please read this carefully. By creating an account, buying, selling or using VeeFam.io in any way, you agree to these Terms and sign them electronically. If you do not agree, do not use VeeFam.io. These Terms limit VeeFam.io's liability, require you to take responsibility for your own transactions, and require disputes to be resolved by individual arbitration, not in court or in a class action.

1. Who we are and what VeeFam.io does

VeeFam.io (also shown on the site as V2V; "VeeFam.io", "we", "us") runs an online marketplace where independent buyers and sellers ("users", "you") list, buy, sell, offer on, auction and trade collectibles. VeeFam.io is a venue only. We are not the buyer, seller, owner, agent, auctioneer, appraiser, shipper or insurer of any item. We do not inspect, authenticate, grade, store or guarantee any item, listing, user or transaction. Each sale or trade is a contract directly between the buyer and the seller.

2. Your responsibility

• You are solely responsible and liable for everything you do on VeeFam.io: your listings, descriptions, photos, prices, purchases, payments, shipping, trades, communications and compliance with all laws, including tax laws.
• Sellers are solely responsible for owning what they sell, describing it honestly and completely, shipping it promptly and safely, and any returns, refunds, taxes and legal duties that come with selling.
• Buyers are solely responsible for reading listings, asking questions before buying, paying as agreed, giving a correct address and inspecting what they receive.
• Do not transact with anyone you do not trust. Use your own judgment. Ratings, reviews, verified checkmarks and sold-price information are provided as-is and are not a guarantee of anyone or anything.

3. Keep every payment on VeeFam.io

Never send money, items or payment details outside VeeFam.io's checkout (for example by a direct Zelle, Venmo, Cash App, PayPal, crypto or bank transfer arranged between users, or by meeting in person). Any transaction, payment or trade arranged or completed outside the VeeFam.io checkout is entirely at your own risk, is not covered by these Terms' dispute help, and is void as far as VeeFam.io is concerned. Accepted trades are arranged between the two users, at their own risk.

4. Disputes between users

If a buyer and seller disagree, they must first try to resolve it with each other. VeeFam.io may, but is never required to, look into a disagreement, contact the users, hold or release funds it holds, cancel or refund an order, remove listings, flag an order, or suspend or close accounts, in its sole discretion. Any help we give is a courtesy; it does not make us responsible for the outcome or for any loss, and our decision is final as between you and VeeFam.io.

5. No responsibility for losses

To the fullest extent permitted by law, VeeFam.io is not responsible or liable for any loss of money, items, products, data or information, or any other loss or damage of any kind, however caused, including loss from: items that are fake, damaged, misdescribed, lost, stolen or never sent; non-payment, chargebacks or fraud by any user; shipping carriers; payment processors, banks or crypto networks; hacking, outages, errors or data loss; listings, prices or sold-price information; or anything a user does or fails to do.

6. Disclaimer of warranties

VeeFam.io, the site, its tools (including AI suggestions, photo search and sold prices) and all content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or that the site will be uninterrupted, secure or error-free. Some states do not allow certain disclaimers; in those states the disclaimers apply to the fullest extent allowed.

7. Limitation of liability

To the fullest extent permitted by law, in no event will VeeFam.io, its owners, operators, employees, contractors or partners be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, revenue, data, goodwill or items, arising out of or related to these Terms or your use of VeeFam.io, even if advised of the possibility. VeeFam.io's total liability for any and all claims will not exceed the greater of (a) the fees VeeFam.io actually kept from your own transactions in the 12 months before the claim, or (b) $50. This limit applies whatever the legal theory (contract, tort, negligence, strict liability or otherwise). Nothing in these Terms limits liability that cannot be limited by law.

8. You protect VeeFam.io (indemnity)

You agree to defend, indemnify and hold harmless VeeFam.io, its owners, operators and partners from any claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of your listings, purchases, sales, trades, payments, shipping, content, conduct, violation of these Terms, or violation of any law or the rights of anyone else.

9. Fees, payments and payouts

• VeeFam.io keeps a fee of 5.55% of each sale. 2% of each sale, out of that fee, goes into the community giveaway wallet. Buyers and sellers pay nothing extra for the wallet.
• Sellers are paid the rest to the bank account they give us, as soon as practical; we aim for 24 to 48 hours after a sale is paid, but timing is not guaranteed and may be delayed for review, disputes, chargebacks, holidays or bank processing. Card sales may be paid by our payment processor under its own terms.
• We may hold, offset or reverse payouts for refunds, chargebacks, shipping-label charges, fees owed, suspected fraud or violations of these Terms.
• Giveaways, votes and the community wallet are run at VeeFam.io's sole discretion, may change or end at any time, and create no right to any prize or money.

10. Prohibited conduct

You may not: sell items you do not own or that are counterfeit, stolen or illegal; mislead anyone; manipulate prices, bids, reviews, votes or ratings; arrange payment outside VeeFam.io; harass anyone; misuse other users' information; break or overload the site; or break any law. We may remove content and suspend or close any account at any time, for any reason or no reason, without liability.

11. Information and privacy

We collect what is needed to run the marketplace (such as your name, email, address, orders and, for sellers, payout bank details, which we store encrypted). We share a buyer's shipping details with the seller of a paid order, and we use service providers for payments, email and hosting. You are responsible for keeping your password safe and for everything done with your account. No system is perfectly secure; see section 5.

12. Electronic signature and records

You agree that ticking the agreement box and typing your name is your electronic signature, has the same force as a handwritten signature under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and each state's Uniform Electronic Transactions Act or equivalent law, and that we may give you these Terms, notices, receipts and other records electronically. We keep a record of when and from where you agreed. You may print or save these Terms at any time from this page.

13. Arbitration and class action waiver

Any dispute, claim or controversy between you and VeeFam.io arising out of or relating to these Terms or VeeFam.io will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, not in court, except that either party may bring an individual claim in small-claims court. You and VeeFam.io waive any right to a jury trial and to bring or join any class, collective or representative action. The Federal Arbitration Act governs this section. You may opt out of arbitration by emailing us within 30 days of first agreeing to these Terms.

14. Governing law

These Terms are governed by the laws of the State of Illinois and applicable federal law, without regard to conflict-of-law rules. Where a court is permitted, the state and federal courts located in Lake County or Cook County, Illinois have exclusive jurisdiction.

15. Changes, termination and everything else

• We may change these Terms at any time by posting a new version; if you keep using VeeFam.io, you accept the new version, and we may ask you to agree again.
• You may stop using VeeFam.io at any time. Sections 2 to 8 and 11 to 15 survive.
• If any part of these Terms is found unenforceable, it will be enforced to the fullest extent allowed and the rest stays in effect. Our not enforcing a part is not a waiver. These Terms are the whole agreement between you and VeeFam.io about the site. You may not transfer them; we may.
